Lambdaistanbul LGBT+ Solidarity Association Personal Data Protection Law (KVKK) Information Notice

1. Introduction

As an association, we attach great importance to the protection of the personal data of our members, donors, volunteers and all other stakeholders. Accordingly, we have prepared this text, which sets out the principles governing the processing, storage and protection of personal data within the framework of the Personal Data Protection Law No. 6698 (“KVKK”). This text explains how personal data is collected, processed, stored and secured. 

2. Definitions

  • Personal Data: Refers to any information relating to an identified or identifiable natural person.
  • Data Controller: Refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
  • Data Subject: Refers to the natural person whose personal data is being processed.
  • Data Processor: Refers to a natural or legal person who processes personal data under the authority of the data controller.

3. Your Processed Personal Data and the Purposes of Processing

Shared with Lambdaistanbul:

  • Identity Data: Name, surname, date of birth, gender.
  • Contact Data: Telephone number, address information, email address.

These personal data are processed in accordance with your explicit consent and within the scope of the exceptions provided for by the KVKK, in connection with and limited to the purposes specified below:

  • Sending association newsletters,
  • Processing website membership applications,
  • Organising events such as training, conferences, seminars, symposiums, and managing participation processes,
  • Providing information about association activities.

4. Principles and Procedures

  • Data Collection: Personal data is collected by our association based on explicit consent and within the scope of the exceptions stipulated by the Personal Data Protection Law. The collected data will be processed only for the purposes specified in this document.
  • Data Processing: Personal data shall be processed in accordance with the law and the rules of good faith, accurately and updated where necessary, for specific, explicit and legitimate purposes. Data will be processed in a manner that is relevant, limited and proportionate to the purpose for which they are processed and shall be retained for the period required by the relevant legislation or necessary for the purpose for which they are processed.
  • Data Storage and Security: Personal data will be stored with the necessary technical and administrative measures taken to protect it against unauthorised access, unlawful processing, loss, destruction or damage. Information security standards will be followed during the storage of data.

5. Transfer of Your Personal Data

The personal data you provide to us may be transferred to the following persons and organisations for the purposes and within the limits specified above:

  • Third-party service providers with whom Lambdaistanbul collaborates or from whom it receives services (such as cloud services, server services, etc.),
  • Lambdaistanbul’s affiliated or subsidiary organisations, consultants, volunteers, employees,
  • Authorised public institutions and organisations, courts, and other legal authorities.

Furthermore, in accordance with the laws of the Republic of Turkey and the requests of regulatory and supervisory authorities, the sharing of your personal data may be mandatory.

6. Legal Framework

Our association complies with the following legislation and legal regulations while fulfilling its obligations regarding the protection of personal data:

  • Law No. 6698 on the Protection of Personal Data (KVKK)
  • The European Union General Data Protection Regulation (GDPR) (for data processing activities related to the EU)
  • Other relevant local and international legislation

6.1. Legal Basis for the Processing and Transfer of Personal Data

Your personal data is processed by Lambdaistanbul under Article 5 of the KVKK:

  • To fulfil website membership and event participation,
  • To fulfil our legal obligations,
  • It is processed in accordance with Lambdaistanbul’s legitimate interests and based on your explicit consent.

7. Rights of Data Subjects

Individuals whose personal data is processed may exercise the following rights by contacting our association:

  • Right to Know Whether Data is Processed: You have the right to know whether your personal data is being processed.
  • Purpose of Data Processing: You may learn the purposes for which your personal data is being processed.
  • Access to and Correction of Data: You may check whether your personal data is accurate and request the correction of any incomplete or incorrectly processed data.
  • Deletion or Destruction of Data: You may request that your personal data be deleted or destroyed.
  • Data Sharing: You may request information regarding the sharing of your personal data with third parties and withdraw your consent.

Accordingly, pursuant to Article 11 of the KVKK, you have the following rights regarding your personal data:

  • The right to learn whether your personal data is being processed,
  • To learn the purpose of the processing of your personal data and whether it is being used in accordance with that purpose,
  • To know the third parties to whom your personal data has been transferred within or outside the country,
  • To request the correction of your personal data if it has been processed incompletely or incorrectly,
  • To request the deletion or destruction of your personal data if the legal grounds for processing your personal data no longer exist,
  • Objecting if a result detrimental to you arises solely from the analysis of your processed personal data through automated systems,
  • To request compensation for any damage suffered as a result of the unlawful processing of your personal data. 

8. Data Subject Requests and Data Security

Our association demonstrates the highest level of sensitivity in ensuring the security of personal data. Please do not hesitate to contact us with any questions, requests, or complaints that may arise during the processes of protecting and processing personal data. We will consider all requests and respond as soon as possible within the legal framework. Our aim is to always be transparent and sensitive regarding the security of your data.
